The telcos caught breaching NBN service rules

The Australian Communications and Media Authority (ACMA) has found TPG, Optus, Dodo and Telstra in breach of consumer protection rules after more than 1500 of their customers were left without telco services while trying to migrate to the NBN.

Rules put in place by ACMA stipulate that a telco must supply a replacement service after three working days of a customer being left without a service during a failed attempt to connect to the NBN.

ACMA chair Nerida O’Loughlin said four related ACMA investigations found 1586 breaches by these telcos due to their failure to supply any replacement services.

“Many Australians rely on phone and internet services for their work and home lives, and significant disruptions can have a heavy impact on their livelihoods and wellbeing,” Ms O’Loughlin said.

“TPG, Optus, Dodo and Telstra have all let down these customers and effectively left them high and dry during the NBN migration.”

Additional rules require that, if after 20 working days the NBN connection is still not working, the telco must develop a remedial plan to address the issue.

If the service is still not working after 40 working days, it must conduct a technical audit to identify the necessary steps to complete the migration.

ACMA’s investigation found that these steps were also not being taken by these telcos, with 5158 breaches of the rules due to remedial plans and technical audits not being undertaken by the providers.

All four companies have provided court-enforceable undertakings to introduce measures to improve compliance with the service continuity rules. They must report back to the ACMA each quarter for 12 months.

If these telcos do not comply with the enforceable undertakings, the ACMA can start proceedings against them in the Federal Court.

Have you had problems migrating to the NBN since it was installed in your area? Did your telco provide a remedy?

7.4 million homes/business connections so far (June '20), 1,586 breaches of the rules = NOT VERY MANY

How very dare you, Greg, letting truth get in the way of a story.

Good one Horace. We are about to have Telstra connect us to NBN. Don't really want to change as they kept on mucking up our acounts, and after monthly conatct and compaints they gave us a $3700 credit out of the blue (much much more than the amount I was contesting) , so we are are still using that to pay our telstra bills.

Louise you do know that you do NOT have to keep the same supplier when you change to NBN right, despite what the Telco may imply?

We 'migrated' to NBN about July 2019. After hearing many stories of extremely bad experiences I was hopeful I would escape the morass of problems some people reported. I can report that in the 13 months of NBN we have had no issues, apart from a minor issue with our landline phone which was quickly resolved 'on-line'.

We have a hybrid connection which utilises the 'old' Foxtel co-ax cable rather than the phone line. Our changeover went smoothly. Prior to the NBN Telstra did change our Foxtel from cable to a satellite connection, presumably, I suspect, was to reduce traffic on the NBN.

Whatever our broadband, land-line phones and satellite Foxtel are all working satisfactorily, touch wood.

I had telstra for nearly 50 years. NBN came along. Telstra sales men tried to stitch me up with an unlimited internet for $99. Great idea when I would only use the normal landline (plus internet) for $73 per month and use approx 25Gb / month of the 200Gb

Why would I want unlimited for an extra $26?

No amount of discussion the salesman wanted to sign me up.

Got rid of Telstra as a package, got rid of the Indian call centre concerns to my computer not working, got rid of the 7pm calls from unknown blood suckers looking for a "bunny". So far not used all my allowance and have approx 360Gb on my phone account.

Nbn with westnet, Mob ph having unlimited mob calls, unlimited O/S seas to 18 Countries with Aldi. They add the balance of my monthly data allowance to my account all for $25/mth.

Leave it with everyone. Westnet no problems, Aldi no problems-may not give coverage in an out of the way country area, I live in a largeer country town and have no problems.
