Shock jock breaches decency standards

An Australian Communications and Media Authority (ACMA) investigation has found radio station KIIS 1065 in breach of rules relating to generally accepted standards of decency due to comments made by Kyle Sandilands about the Virgin Mary and Christian beliefs. 

ACMA investigated an episode of Kyle & Jackie O that aired on 18 September 2019after receiving 180 complaints alleging that the segment was offensive and incited hatred and ridicule of Christians.

The comments were made on 18 September and involved Sandilands accusing the Virgin Mary of being a “liar” who was “chock-a-blocked” behind a camel shed and calling the Bible “dumb as dogshit”.

The ACMA investigation made under the Commercial Radio Code of Practice found the broadcast contained offensive statements to listeners of faith and the wider community.

“Australians are generally tolerant of irreverent humour and critical discussion about religion. But they would not expect a host of a broadcast program to derisively criticise people’s intelligence because of their religious beliefs,” said ACMA Chair Nerida O’Loughlin.

“Mr Sandilands overstepped the mark in terms of the generally accepted standards of decency in this case.”

The investigation found that the high threshold for a breach of rules relating to inciting hatred and severe ridicule because of religion was not reached.

“While the comments were offensive, they lacked the necessary element of likely incitement, in all the circumstances, of hatred, serious contempt or severe ridicule in the audience, which is the test in the rules,” Ms O’Loughlin said.

In response to the ACMA’s findings, KIIS 1065 has counselled Mr Sandilands and will ensure its staff legal compliance training will reference the broadcast and breach findings.

The ACMA considers these actions as sufficient remediation by the licensee in this case particularly given it has not had any breaches of the decency provision, across any of its programs, in the past 10 years.

I think Sandilands is despicable..I have no time for trash who insult other people's religious beliefs or books.

You may not believe what they believe but that does not give you the right to use vile comments.

The problem is not Sandilands. He is just doing what he is paid for. Being a dickhead and attempting to 'outrage' people to gain coverage. Typical stuff for this tired overpaid mediocrity obviously losing ratings. The problem is his employers allowing this kind of daily nastiness to be broadcast in order to gain an audience of dumb listeners. The problem is the program's sponsors who support this grubbiness with money. And, most of all, the problem is whatever controlling body oversees these verbal garbage dispensers and their vomit so poorly. He knows that he can 'apologise', that is backpedal, afterwards as if unaware that he was offending, and just get a minimal fine. Fancy working with this person, fancy living with him. The stench must be unbearable.

The publicity was worth a mint.

There should be a law against preaching lies.  There needs to be proof for of all these controling cults to expound what they say.

But there is a way to quietly question religion.

Still didn't say he was wrong in his content, just in his delivery. 

It wasn't his delivery that got him into trouble. His comments about Virgin Mary of being a “liar” who was “chock-a-blocked” behind a camel shed and calling the Bible “dumb as dogshit” did not breach any laws or regulations.

Trouble came because some listeners took umbrage because he linked their intelligence with religious beliefs. He would have been cleared in full if he had not said "You might believe everything that's written down 2,000 years ago to be absolutely accurate and good on you, you're dumb. Dumb as dog s**t."

As you say, nothing wrong with the content but why these people listen and are then surprised when offended is another question. Perhaps they are just as dumb as Sandilands says but it has nothing to do with their religious beliefs.

Yes, I agree his delivery was wrong --

If he had said that about another religion (you can guess which one) all hell would of broken loose with riots, demostrations etc the police arresting this piece of shite for inciting hate. He has & always will be a nasty human being with no respect for any one.

He has made a living out of being crude and offensive to gain attention in a small work place.The more attention he gets, the more people are drawn in to listen to his drivel, the more advertisers get heard, the more money the radio station gets. It pays (well) to be crude, rude and offensive. The same could be said of the majority of commercial radio DJs - male and female.

He's a dipshit. Why anyone would listen to his drivel is totally beyond me.

In Iran or Pakistan he would mostly likely have been beheaded! There are ways of diplomatically expressing disbelief in others' religions without using such blatantly offensive language. Sandilands should be banned from all media. He certainly doesn't warrant being paid for his insulting tirades.

Gotta love these shock jocks who know everything and are experts in everything. Not. They seem to be having a race to the bottom.

The guy is a very unhealthy person who is allowed to laugh all the way to the bank because all the dumb bells who listen to him have to find an outlet for their personal s**t and he provides it. Why make this cockroach rich??? Shockjocks are becoming a thing of the past in many countries.

If you don't  like what he says, don't listen to his program, simple!

No Tood, it's not that "simple" ...I do not listen to Kyle and am not particularly religious and I don't take what's written in the Bible as the whole truth and nothing but the truth.

However, foul language is foul language. Amen.
