Reports in Fairfax Media of the former prime minister firing salvos from New York at his usurper in the form of text messages urging Liberal MPs to refer Peter Dutton to the High Court.

In Mr Turnbull's first public comments since losing the prime ministership he called on his former colleagues to seek clarification of Mr Dutton's position in Parliament.

Mr Turnbull's ousting meant the government lost its one-seat majority. Should Mr Dutton be forced to walk, his seat in Dickson – which he holds by a slender 1.6 per cent margin – would effectively mean the government loses power altogether.

The Solicitor General had already advised Mr Turnbull that "Mr Dutton is not incapable of sitting", but added that "it is impossible to state the position with certainty."

Shadow Attorney-General Mark Dreyfus says that Mr Dutton's stake in childcare centres that receive federal childcare subsidies disqualifies his position in parliament under section 44 of the Constitution, which says that any person who "has any direct or indirect pecuniary interest in any agreement with the Public Service of the Commonwealth" is disqualified.

Mr Turnbull is concerned about the cloud of doubt hanging over the head of the Home Affairs Minister, but his former colleagues say its just "desperate nonsense".

"Malcolm is hurting, I understand that," said a Dutton supporter. "But this is desperate nonsense. He has no regard for the prime minister and no regard for the Liberal Party."

More akin to a tantrum I'ld say. However, the Labor Party are very supportive of Turnbull, I've noticed.

OK sure the $528,000 pa PM salary was donated and tax deductible but at what rate? If the rate dropped then the tax deductibility would be worth less. Do try to be a little more clever with your arguments rather than parroting union BS. You're not talking to children here.

In the polls Turnbull held a comfortable lead over Shorten as preferred PM. Newspoll showed the the Coalition as a party was losing to Labor by a huge margin. So it wasn't Turnbull but his own party in the Cabinet that became unpopular. Turnbull's flip-flops were the result of his own cabinet's lack of support, lack of unity on policies and the 'ides of march' conspiracy by characters inspired by mutineers, two radio broadcasters....and Newspoll...one of Murdoch's companies. Turnbull wasn't the problem, the Cabinet and the Party is the problem!!!

As you are well aware Adrianus I am talking about the circa $150 million in offshore tax shelters more than the few million invested here.  You know that.

Nobody will ever know how much tax is evaded because this government introduced laws to hide the affairs of those at the top from the media so that they could legally launder their income with nobody the wiser.  Tell me I'm imagining that.

HS, Turnbull won the party leadership in a democratic vote. If he came out smelling like roses and his party was on the nose then he is responsible. It is the leader's job to increase his majority of support from within his party, not alienate them to the point where he loses their ear. He is doing everything within his power to make sure LNP loses the Wentworth bi-election. His son is raising money for the ALP candidate. The party did the right thing by exposing his lack of loyalty.

Trust accounts, like off shore accounts,  were around when Rudd and Gillard both Labor PM's were last in power. they too had ample opportunity to do something. 

In fact real loop hole closing on tax evasion hasnt been tackled in real terms since Howard was Treasurer back in the 1970's with various schemes going back then. 

I suspect far too many MPs and Senators of all persuasions hold one or both. 

Because its a fact that although the very wealthy do pay more income tax - they actually dont pay the same percentage of their total real income,  as do those on PAYE. 

The urbane, smiling, veneer turns out to hide a very mean spirited and childish personality.

All money that goes to the centres is passed onto the parents.

But, then the parents pay the centres out of what they receive!...hmm?

HS with that in mind any MP with a business which has pensioners as customers would need a high court ruling under sect.44?

And as the Liberal Party MP spruikers repeatedy said "the Liberal Party does not knife its sitting PM".  No mention of that.  Also no mention of the HUGE debt THIS GOVERNMENT has produced for our country whilst Rudd had his small GFC forced debt laundered on the media repeatedly day in and day out.

Agree.  Dutton would have even worse than Abbott or Turnbull but the coal industry gets rid of anybody who talks emmissions targets be they ever so miniscule.

Mr Dutton has single handedly crucified the Liberal Party at the next election. Malcolm doesn't have to do or say anything. Neither does the Labor Party.

I dislike Dutton intensely for many people in Nauru and Manus detention camps have suffered at the hands of this cretan.Dutton claims he is a good honest man and of very high integrity - he is nothing more that a power seeking, dishonest and scurilous lttle man and it is time someone got him out of the government and politics altogether. Keep it up Malcolm.

We might even see the demise of the other cretan, Scott Morrison who is trying to ride on his Christian 'ticket'. What sort of Christian he claims to be is questionable for Christians must help the poor, the dispossesd, the suffering, those in poverty, the disavantaged and others yet all he does is to make the rich richer, the powerful more powerful and the corrupt more corrupt. I  don't think Scomo or Scumo will be around long I think he was let have it because they know (Dutton & Abbot ) the backlash will dump the liberal leader at the next election so he is just the sacrifice !

I think Mr Turnbull, private citizen, is perfectly entitled to indulge in private, if not public, correspondence with former collegues on any matter political or otherwise. In this case I agree with him. If Mr Dutton was a person of integrity he would refer himself to the High Court, if for no other reason, to remove any potential damage to the government notwithstanding the opinion of the Solicitor General. From my limited understanding of the situation I feel there is a very good chance the High Court may find in Mr Dutton's favour.

Several years ago a MP, who was in receipt of a DFRDB pension in consequence of his military service, was referred to the High Court. The Court ruled that being in receipt of a pension was not an 'office of profit' and he was eligible to sit in Parliament. Mr Dutton may well be in a similar circumstance. The only way of being certain is to get a ruling from the High Court.

And get rid of Bishop too.  She's given away far too much Australian money when our own farmers (essential services) could have done far better with it. She continually sucked up to the UN, even pouring a huge sum of our money into an organisation that supported a terrorist outfit.  She's been sashaying around the world doing what? apart from displaying beautiful clothes.  Bishop is one of several reasons I do not like or would ever vote for female politicians (and I'm female) and certainly do not support gender-biased "quotas".  Women quotas are patronising and going by many of the ones who held high political office in the past they're no recommendation for the future the most outstanding failure Gillard with her AWU scandal and affairs with married men.

Funny how Turnbull didn't refer Dutton anywhere when he needed him to make up the numbers. Turnbull is an egotistical, narcissistic little toad who felt he should be prime minister. As a younger man, when asked which party he would like to lead as Prime Minister, his reply was, "Any".  If anyone has been to the UK and Europe of late and witnessed what happens when borders are thrown open for all and sundry - social disorder, cultural losses, unsafe towns and cities, large numbers indefinitely living off the taxpayer purse, ignorance of host country language - then Dutton and Morrison's roles in keeping our borders policed looks pretty good to me.  I never cared about Turnbull's wealth because I don't believe in class envy.  What I do care about is someone who ran away when defeated fairly only to nastily snipe from a distance.  What fools the liberals were to be sucked in by this horrid little man.  

They were sucked in by their own gigantic egos and lust for power. They put Turnbull in when they thought he could win for them, which he did by one seat, then they got rid of him when they thought he might lose the next election. They were too dumb to recognise that Dutton, Abbott and Morrison are even less popular than Turnbull. 

Yes, before Turnbull's axing there was no problem with Dutton. There was no Bullying. There was no appalling behaviour. No sexism. Now there is talk about Rudd style swearing and temper tantrums. Tanya Plibersek now says she can swear as well as the next person. Where is all this coming from?? I guess a week really is a long time in Politics.   

The other odd change which I've noticed is the sentiment toward Turnbull by the left leaners. After continual envious remarks aimed at his wealth, they have done a 180. Now he is poorly done by and didnt deserve to be turfed by his own party. It becomes more apparent that I may have been one of the few people who had no idea Turnbull was a lefty plant.

Robi, you may have spoken too quickly? Give Morrison a couple of months after the door slamming and you may find he is more popular than Bob Hawke or Kevin 007? 

Adrianus, it doesn't matter how popular Mr Morrison turns out to be, we do not vote for a Prime Minister - we vote for our local candidate. It isn't going to take much of a swing towards Labor for them to come in with a landslide victory.

I wish the National Party would step up and start putting forward more contenders in marginal seats.

Robi, how predictable is bias.  Remember how Shorten facilitated the removal of two Prime Ministers (Rudd and Gillard) in order to "shorten" his own leadership waiting time in the guise of the assumption that either sitting Prime Minister could not deliver victory.  In Shorten's case the knifings were purely an act of self-interest.Back stabbing is no stranger to Labor.  As for Morrison, if nothing else thus far, he closed our borders and not before time.  I don't want my grand-daughters growing up fearful of putting a foot out their door minus head or body-covering because that's the way western countries with porous borders are heading.

 

Rosret, someone must be voting for Morrison otherwise he wouldnt be Prime Minister. Shorten asked the question, which could have come from a Laurel and Hardy skit "Mr Morrison why do Australians have a new Prime Minister?" Was Shorten unaware there had been a change? Or was he exercising his right to inflict as much embarrassment as he himself experienced during his contrived passage to the ALP leadership? You dont become PM without getting a few votes. 

In 2007 Gillard was always the preferred ALP leader while their man Shorten was learning the ropes, but the unions knew she couldnt win the election, so they wheeled in Rudd whose job it was to get them over the line, retire after 12 months on medical grounds, hand over to Gillard who, after serving a term then hands over to Shorten. The succession plan would have worked ok but nobody planned on Kevin 007 thinking that he was actually in charge. The point is that Rudd was as much disliked by his own party before 2007 as he was afterwards. The only difference was that he angered the hard left in the ALP because he wouldnt do what he was told.

Many Labor voters and the unions would like to think that people dont vote for a Prime Minister because they have lessened the value of the office of Prime Minister and intend to continue lowering the standard. Would voters vote in a party which has the most unpopular leader? The face of the party. A person who is representative of that party?

 

 

Bad idea Turnbull ! Cut your losses and enjoy the rest of your life with your family while watching your old party mongrels tear themselves apart and implode. Go and 'smell the roses'. Movies, theatre, ballet and write a 'tell all book'.
