Linear Park Rapist - they are joking, right?
SA report today:
The Linear Park sex offender will be re-sentenced by the State's highest court because his 16-year jail term is deemed excessive for a young man.
Aiden Driver, 20, broke into the home of his first victim and raped her while pushing his arm down across her throat.
He then attacked two women in Linear Park, locking one in a bear hug before trying to drag her into the bushes.
Yesterday, the Court of Criminal Appeal said it was "inclined" to overturn Driver's sentence.
The announcement follows the court granting Driver permission to appeal on the grounds the penalty was "manifestly excessive" for a young man who had no criminal history and had a turbulent personal life......"
This mongrel took a guilty plea to offences including indecent assault, rape and home invasion.
The report goes on to say that originally the prosecutor wanted Driver jailed indefinitely as an uncontrollable sex predator.
"Based on the opinion of two psychologists, Driver is unwilling to control his sexual instincts," he told the court in June.The judge was concerned to say that the rapist needed to be "brought under control".
" ... you have no understanding of the state of mind, position or fear of these women," the judge said. He ordered Driver serve a minimum 10-year prison term.
It's par for the course. Do gooder judges, who seem to not realise they are there to administer the law, but, rather, act as counsellors .
Many children come from 'turbulent childhoods'. The majority go on to lead normal productive lives. I place violent rape in the same category as murder. But then , it's not I who is sitting up there meting out 'punishment.
