DNA 'not a basis for conviction', court told

The High Court in Canberra has been told DNA evidence alone should not be the basis for criminal convictions.

An ACT Supreme Court jury convicted Benjamin Forbes of sexually assaulting a woman in 2005.

During his trial it was revealed that his sample was found on the victim's clothing.

Forbes appealed against the guilty verdict arguing too much weight was put on DNA evidence.

Now the case is before the High Court.

Forbe's lawyers argued DNA evidence in criminal trials only provides an estimate of probability and is not an expression of real or known facts.

The court also heard, DNA evidence should not be presented in a vacuum and other material must support it.

I wonder how many have been convicted on DNA evidence alone so far.

Just shows you, all you need is a smart lawyer...

So all this DNA science is just a lot of hot air?
