You would think twice about having flower or veggie stakes in the garden after reading this. What if some dill climbed the fence and fell on one?

South Ballarat woman Michelle Egglestone, 35,sustained serious internal injuries when the picket penetrated her groin, requiring surgery.

Ms Egglestone is seeking damages and loss of earning capacity from Leslie Furness, of Smythes Creek, following the incident on November 1, 2008, according to documents filed in Victoria's Supreme Court.

She also sustained pelvis and lower abdominal injuries, claims she has post-operative scarring, depression and anxiety and post-traumatic stress disorder and nightmares resulting from what happened.

Mr Furness — her former fiance — was the owner and occupier of the house, therefore Ms Egglestone believes he was negligent in not providing adequate balustrading on the veranda and uncapped star pickets in the garden area below, where Ms Egglestone fell.

This did not comply with building regulations and failed to minimise the risk of injury to anyone coming into contact with any pickets, the writ claims.

Mr Furness should have provided adequate warning about it and his failure to do so exposed Ms Egglestone to "risk of danger of injury which could have been avoided with reasonable care on the part of the defendant ... which the defendant knew or ought to have known," it states.

The writ claims Mr Furness had also failed to exercise due skill and care in the maintenance of the premises.

The personal injury matter is expected to go to trial at a later date.[/quote]

Usually it is landlords being hit with insurance claims, so this is a switch. I have to ask though, if the owner should have known about the building regulations and the risks, why not the person peeing over the balcony? Likewise was the owner of the posterior taking due care of it when she dangled same over the balcony to kill the vegetation below? Then there are the health regulations, but I guess the owner was responsible there as well.

Could all risks have been avoided by using the porcelain bowl instead? [Mental note, must post warning signs before the next party and definitely no garden risks next season. There go the Dahlias (tears in eyes) and tomatoes ].

No won't invite her to my place either fwed, :-), whether she is the sueing type or not I don't think I would like her killing my plants in that way, geez that would have to be a site for poor eyes. :)

Shouldn't the action be against God for creating the trees from whence the

offending pickets came? Isn't it about time we legally banned all offending

items. We should start with the biggest offender, the motor car followed by

hospitals which have a direct correlation of well over 90% with the demise

of human beings. We should then ban all natural sex because the awful

perpetrators cause the birth of the worst causes of carbon dioxide &

therefore climate change. The mind boggles.

God, I hope that Julia doesn't read this or we might have the onset of a new

problem.

Suing her Fiancee for some stupid act that she did..........mmmmmmm..........my cynical side sees it as a good way to get started in life........weddings do cost a lot these days and.....yes there is the house to get. :)

PlanB, it's just my cynical side coming out, I try to look at all sides of the coin so to speak and I can assure you that people do try all sorts of tricks. I'm not saying she went off the roof on purpose, what I'm saying is after the accident ( I prefer to call it a stupid act for which she is fully to blame) has happened, they have looked for the 'silver lining', there is always one in every cloud. :)

Some courts have ruled that a host is not responsible for the conduct of guests and if one of your guests is playing around and hurts himself, you probably will not be liable.



But you might be liable if you let your guest drink too much then they hurt themselves.

Or drive off in their car and have an accident.

Apparently it can be a fine line on whether they brought their own alcohol or if you supplied it.

The danger is that seniors who own property might underinsure or fail to insure through increasing financial hardship.



Many would be finding difficulty maintaining their homes and that affects insurance as well (insurer could refuse to pay up).
