I have been looking online for the answer to this, but can't really find a clear answer. I own my house for the last 18 years, it is mine paid for by me in my name only. I pay all the rates. I have been married two years and things are not going so well. If we were to divorce is my house included in the divorce settlement or do we go with what we came with, in her case NOTHING.

Apparently, the family law version is that, your girlfriend, mistress, defacto or your spouse who has lived with you in the same house that you own for longer than 6 months, is entitled up to 50% share  of it. 

She will get the lot. That is why I don't own a house in my name.

You need to get legal advice and soon if divorce is your intention. Know where you stand, it's worth the money. I suspect HS is right but the news is probably worse than that. My understanding is talking to other guys is you need to manage this well if you don't want to lose your shirt. If she's been married before she's probably already setting you up. 

For any other guys out there who are considered marriage, seriously don't be an fool.Especially if you are getting on in years because it's almost impossible to recover. You're being used as her retirement plan. Hi There See what you think of OG comment when all this is done. we have only been married 18 months, and your telling me she will get the lot, she put in F... all towards my house.  I was after comments from people that new what they were talking about.

Then pay for the legal advice, and argue with them. It's a very small bill compared to the money you will have to pay her. 

By the way if you have superannuation she is entitled to some of that as well and she didn't work for that either. 

..and  she can claim money from your bank accounts.  

Does't this poor woman deserve some return for putting up with you for close on 2 years?????

No Reagan she deserves what she worked for which is nothing.  But we are talking about what she's legally entitled to which is a whole different thing. If he was paying for a housekeeper he would only be up for two years pay.

I truly feel for you. Having worked in law for a long time search for free legal advice where you live. Make sure you gwt advice via a family law lawyer though. In WA we can make an appointment with rhe Citizens Advice Bureau. Ring the Law Society in your State and they should be able to tell you where to get some free advice. Google it to. Some law firms offer an hours legal advice free BUT MAKE SURE YOU SPEAK TO SOMEONE WHO SPECIALISES IN FAMILY LAW. 

 

Even if people don't marry the other person can make a claim on property etc if they are those sort of people!! 

 

Be careful of lawyers though. They can milk you big time. Every time u phone them ir costs you 6 minutes or more. Does she have the means to fight it??? I hope she walks away.

If you have a lot ro fight for GET A GOOD LAWYER.

how the total asset pool (yours and hers) ends up getting divided depends on a number of factors

the length of the relationship - not just marriage but refactor prior if applicable

your individual contributions since you were together

how much you each brought into the marriage in terms of assets

your income disparity 

etc

As Tib advises - see a lawyer or a family mediation lawyer more precisely

you May want to avoid going to court and reach a settlement because going to court will set you back anything upwards of $50k each 

in my opinion- worst case for you is she takes 55% but I can’t see that happening as it was a short relationship and you brought those assets into the marriage 

It’s not just the house that is considered - all assets including super balance , shares , account balances etc less any liabilities 

Typo - meant length of defacto relationship is also considered

Raphael it's probably an unfair pay rise to women less qualified and who do less work. It must have some companies thinking its a bad idea to have a female CEO. I hope they sue the company for back pay and it gets a nice fine to go with it. It would also make me smile if their underpaid male workforce finds a better employer. Let this company keep the female dregs.

true story,    my brother in law,   [widowed,   with adult kids,  ]   meet a woman at a rsl club,    were an item for awhile,     [although , i turned out,  she was married,  with kids still at home]     went for a cruise to tasmania,   and she started making waves about calling it off,     B,I,L,   was in love,    asked her to divorce and marry him,    she did,     she moved into HIS HOME,    bought and paid for when his wife was alive,     the intention always being that when they went,  the house was to be divided for the kids,       THIS woman moved in with a LACE TABLECLOTH,     that was it,  apart from her own things,       it took about 2/3 years,   she wanted out,      took him for the lot,   he had given up work shortly after they met,   and he had heaps of super,   she went for money,  and her share of the sale of the house,    EVEN THOUGH SHE HAD NOT PUT ONE PENNY INTO IT,      my B,I,L, committed suicide over it,    his son found him in the car with the exhaust going,    they went to court,     SHE GOT THE LOT,     THE HOUSE,  SUPER,    EVERYTHING,     go see a solicitor NOW,  if you have any doubts,    get things in writing,   although i dont know how that stands in a court,   but better than leaving it to chance,    good luck,  

Thanks for that story it's way too familiar unfortunately. I try to warn guys of the risk because those who haven't been through it expect it to be fair and it's not. Many men come out of it emotional and financially destroyed and suicide becomes likely. There are many women out there that are just there for the money, not all mind you but it's a high risk venture. Marriage is risky in more ways than one. I ignore some of the comments by ferals when someone like hi there asks a question because I just know he's in for a shock and things can turn out very badly.

dont think a will always makes things easy,  IT DOESNT,   my b,i,l, left a will,   the court overturned it,     hopefully these cases are in the minority,   but why take a chance,    i always thought a will was legal and binding,   but it seems not,  

Same with super, you can name a beneficiary, but it's important to keep it up to date, or make it non-lapsing if possible.  A lot of people don't realise that just naming a beneficiary isn't enough. It can lapse after three years in most cases.

Hi there, I suppose most on here are speaking from experience. Not me though, but I have heard horror stories I wont go into.

18 months is a rather short marriage? I wonder what you both discovered in that 18 months that you didnt in the pre marraige period? None of my business, that's a rhetorical question. 

If you have any joint accounts dont tell your bank that you have marital problems because they will freeze the accounts. And talk to a lawyer as others have advised.
