Aged Pension and Overseas Carer - Quandary

I am an Australian Citizen and resided there for 30+ years mostly working and paying taxes in well paid professional jobs.

My wife is not an Australia resident and has never been there - my intention was to bring her and her 2 children back to Australia to live.

Unfortuly my wife is now pretty ill and has CVT, DVT and another virus that will likely not meed the Spousal visa requirements of Australia (I have not applied yet) - the cost of her medication and regular docters visits and scans etc + hospitalisation would be prohibitive and the issues are lifelong.

So have been overseas 2or 2.5 years with this and the demise of my mother in the UK I have not been able to return.

I am in the process of purchasing a house in Australia which I am locked into (done before I started the investigation on visa entry) - however even with the visa issue my wife has stated that she has free medical cover in her country and would be concerned if we moved to Australia about the cost and would therefore would not go.  She needs me with her as she has limited family (only 1 half sister) her children are below 9yo.

I have arranged for my house to be taken care of by my daughter and her 2 children and she will pay me soome lodgings.  I will be in Australia to conclude the house sale in a couple of months.

My Finances are simple I am 63 have about 160k in the bank in Australia after the house purchase 270k cheap in regional Victoria) I have NO superannuation ( had to be withdrawn on financial hardship in Australia)

I can support myself and wife and her children in the meantime (though only on around 800$ a month).

My issues are:

1. in 3 years I would like to get the aged pension -  how do I do this and care for an overseas wife/family.

2. I have 2 daughters and 2 grandchildren in Austral I have to see them often as I can.

3. I have to retain my Austraian Residency.

4. My home in Australia is my primary place of residence (purchased with money from the forced sale of my Australian home 3 years ago).  I have no other property - I live on land that is owned by my wife and her departed sisters Husband, complicated.

Any solid advice would be gratefully received

Evening Ken

After reading about your situation and the fact that it was posted 7 weeks ago I would assume that you have been put on the right track? If not, then all you can do is go through the system with Immigration and Center link. I do have an understanding about your situation but would be apprehensive about giving you any advise as the system is very complex and you need to have professional advise. However in saying that, I will add that I believe that you need to be living in Aust for 2 years continuously to qualify for the age pension and it does not look good for your overseas family to come to Aust. However that is for the Gov to advise you about.

Good luck

Thanks Gazza,

Is it a 2 year qualifying or 2 years before you can move overseas ?

I find it hard to swallow that after 30 + yrears of tax paying (up to 40,000 +tax in one year ) that I would have this trouble.

Still wondering if I were to claim the pension in Australia ,say 1 month before I turned pension age, I could spend alternate 6 week periods (for 2 year qualifying period)  in Australia and overseas without loosing my pension?.

I would then have to get a carer for my partner when I was in OZ

I would advise you to seek legal advice regarding these matters. It can all be very complicated and sometimes things change from a legal perspective. Advice from lay people may not be reliable.

I hope everything works out for you and your family. Good luck.

Thanks Jim, I have sent an email to the Ministery to try to get some clarification
